The Real Estate (Regulation and Development) Act, 2016, popularly known as RERA, was implemented with a vision to bring transparency, accountability, and efficiency to the real estate sector in India. It was seen as a beacon of hope for millions of homebuyers, promising them timely delivery of projects, protection against unfair practices, and a streamlined dispute resolution mechanism. But nearly eight years since its implementation, RERA seems to be losing its roar. Many are now referring to it as a “toothless tiger” due to its lack of enforcement power. So, what went wrong? Why is RERA unable to deliver on its promises? Let’s dive deeper into these issues.

The Purpose of RERA: A Quick Overview

RERA was introduced to address numerous challenges faced by homebuyers, such as delayed possession, changes in project layouts, hidden costs, and fraudulent practices by developers. The act aimed to:

Ensure Timely Delivery: This act mandates that developers must complete projects within the stipulated timeline or face penalties.

Improve Transparency: All project details, including financial statements, layout plans, and government approvals, must be disclosed on the RERA website.

Create Accountability: Developers are held accountable for the quality of construction, and they must fix structural defects for up to five years.

Set up a Grievance Redressal Mechanism: This Act offers a platform for resolving disputes between buyers and developers promptly.

Why Is RERA Being Called a Toothless Tiger?

Despite these strong regulations, RERA has not been as effective as expected. Several factors contribute to this perception:

Lack of Enforcement Power: The Act authorities, at both state and central levels, lack the power to enforce their rulings effectively. While they can impose penalties, these are often not enough to deter defaulters. Moreover, developers frequently appeal these decisions, dragging the matter into prolonged legal battles.

Insufficient Penalties: The penalties imposed on developers for non-compliance or project delays are often too lenient. For many developers, paying these fines is more cost-effective than adhering to act norms, making non-compliance a viable option.

Delays in Setting Up RERA Authorities: Some states were slow to establish act authorities, which delayed the registration of projects and grievance redressal processes. This led to a backlog of cases and a lack of trust in the system.

Incomplete Project Registrations: Several ongoing projects have not been registered under this act. This happens because the Act does not cover projects that were already underway before its implementation unless the developer chooses to register them voluntarily.

Unresolved Consumer Complaints: Despite numerous complaints being filed by homebuyers, a significant number remain unresolved. The dispute resolution process is lengthy, and the absence of a dedicated the act tribunal in some states only exacerbates the issue.

State-Level Variations: RERA is a central law, but real estate is a state subject. This has resulted in states having their versions of this act, leading to inconsistent regulations and implementation. Some states have diluted the rules, favoring developers, which undermines the act’s effectiveness.

How Does This Affect Homebuyers?

The failure of RERA to enforce its rules has had a severe impact on homebuyers:

Delayed Projects: One of the primary reasons for bringing this act into force was to ensure timely project completion. However, many projects are still delayed for years, leaving homebuyers in a financial and emotional bind.

Financial Losses: Homebuyers end up paying rent and EMIs simultaneously due to project delays, leading to a substantial financial burden. The act inability to penalize developers effectively means that buyers have little to no recourse.

Lack of Transparency: Although act mandates full disclosure, incomplete project registrations and a lack of accountability mean that buyers still struggle to get accurate information on projects.

Diminished Trust: The real estate sector has been plagued by mistrust, and this act was meant to restore confidence. Unfortunately, its weak enforcement has done little to change the perception of buyers who feel vulnerable and helpless.

The Way Forward: Strengthening RERA’s Roar

To transform this act into a more effective regulatory body, several measures can be considered:

  • Granting RERA Authorities More Power: The act needs to be empowered with better enforcement mechanisms. This could include giving it the authority to attach developers’ properties or seize assets in case of non-compliance.
  • Faster Resolution of Disputes: Establishing dedicated Act tribunals in each state and implementing strict timelines for dispute resolution will ensure quicker justice for homebuyers.
  • Strict Action Against Defaulters: Instead of lenient penalties, stricter punishments should be imposed on developers who fail to adhere to Act guidelines. This will act as a deterrent against non-compliance.
  • Mandatory Registration for All Projects: All projects, whether ongoing or new, should be mandated to register under this act. This will bring transparency to the entire sector and cover all homebuyers under the protective umbrella of the act.
  • Uniformity Across States: A standard set of rules should be established across states to eliminate confusion and ensure consistency in RERA’s implementation.
  • Public Awareness: Many homebuyers are still unaware of their rights under this act. Conducting awareness campaigns will educate buyers on how to use this act effectively to safeguard their interests.
Conclusion: RERA’s Potential and the Need for Reform

RERA has the potential to revolutionize the real estate sector and protect homebuyers’ interests, but only if it is given the power to enforce its rules effectively. Calling it a “toothless tiger” is not an exaggeration but a reflection of the current state of affairs. If this act is to fulfill its promise, it needs to roar louder—with sharper teeth and a stronger bite.

For homebuyers, This act was supposed to be the guardian that would ensure justice and transparency. Unfortunately, due to weak enforcement, it currently stands as a symbol of unfulfilled promises. Strengthening the acts powers and ensuring its effective implementation can transform it from a toothless tiger to a true protector of homebuyers’ rights.

By addressing these issues, we can build a real estate ecosystem where both developers and buyers can coexist in a fair and transparent environment. Only then will RERA live up to its original vision and truly safeguard the interests of every homebuyer in India.
